Terms of Service · Sizely

These Terms of Service (“Terms”) govern your use of Sizely (`sizely.io`, related apps, and creator sites on `*.sizely.io`).

By creating an account, using Sizely, or publishing a creator site on Sizely, you agree to these Terms and our Privacy Policy.

Sizely is an independent project operated under the brand Sizely. Contact: support@sizely.io.


1. What Sizely is

Sizely is a platform that lets creators host sites and sell digital content (for example gallery posts, comics, shop items, memberships, commissions), and lets fans browse, purchase, and interact.

Sizely provides software and infrastructure. Creators are responsible for their own content, pricing, fulfillment promises, and customer communication unless we expressly say otherwise.


2. Accounts

  • You must provide accurate account information and keep it updated.
  • You are responsible for activity under your account.
  • One person or entity per account unless we allow otherwise.
  • You must be old enough to form a binding contract in your country. Some features or creator sites may require you to be 18+.
  • We may refuse, suspend, or terminate accounts for Terms violations, abuse, fraud, or legal risk.

3. Creator responsibilities

If you are a creator on Sizely, you agree that:

  • You own or have rights to everything you upload and sell.
  • Your content complies with law and these Terms (including Acceptable Use and Payments).
  • You are responsible for taxes, consumer rules, and disclosures that apply to your sales.
  • You will not misrepresent products, memberships, or delivery.
  • Stripe Connect (or similar) onboarding may require identity and bank verification. Failure to complete required checks may block payouts or selling.
  • Platform fees may apply to transactions; fee details may be shown in the dashboard or checkout flow and can change with notice. See the public Fees page for the current platform rate.

Published creator content may be publicly accessible on your site subdomain.


4. Fan / buyer responsibilities

  • Purchases and memberships are generally between you and the creator, facilitated by Sizely and our payment provider(s).
  • Digital goods may be non-refundable except where required by law, where a creator offers a refund, or where we decide a refund is appropriate (fraud, non-delivery, policy exceptions).
  • Do not share paid content in ways that violate creator rights or these Terms.
  • Chargebacks filed in bad faith may lead to account action.

5. Acceptable use

You may not use Sizely to:

  • Break the law or encourage illegal activity
  • Upload or sell content you do not have rights to
  • Distribute malware, scam users, or phish for credentials
  • Harass, threaten, or dox others
  • Exploit minors in any way (zero tolerance)
  • Bypass paywalls, access controls, or security measures
  • Abuse the platform (spam, mass scraping, excessive automated load)
  • Infringe intellectual property, privacy, or publicity rights
  • Upload extreme illegal content or content we reasonably prohibit for safety
  • Sell or process payments for anything prohibited by our payment providers (see Payments)

We may remove content, disable selling, hold payouts, warn, suspend, or ban accounts.


6. Adult content and payments

Some creator sites may contain adult (18+) material for viewing. If a site indicates adult content, you must only enter if you are of legal age in your region. Creators must label adult sites appropriately and follow applicable laws.

Important — selling and Stripe: Sizely uses Stripe (including Stripe Connect) for card payments and payouts. Stripe’s Prohibited and Restricted Businesses rules apply to the platform and to every creator.

You may not use Sizely’s Stripe-powered checkout, subscriptions, tips, invoices, or payouts to sell or monetize:

  • Pornography or other mature audience content (including literature, imagery, video, AI-generated media, and similar) designed for sexual gratification
  • Adult services (including prostitution, escorts, fetish services, adult live chat, and similar)
  • Any other category Stripe lists as prohibited or that Stripe has not approved for your account when restricted

Hosting or displaying adult material on a creator site does not mean you may charge for it through Stripe. If you sell prohibited goods or services through Sizely payments, we may disable selling, reverse or hold funds where permitted, suspend your account, and report activity as required.

We may add other payment providers in the future. Those providers’ rules will also apply when enabled.


7. Payments and Stripe compliance

  • Card payments and many payouts are processed by Stripe. Stripe’s terms and restricted-business list also apply to you.
  • You must not offer, sell, or collect payment for anything Stripe prohibits, even if another part of Sizely would technically allow a listing.
  • Currency, taxes shown at checkout, and payout timing depend on Stripe and configuration.
  • We may enable or disable selling for a creator for risk, legal, policy, or payment-provider reasons — including suspected Stripe-prohibited activity.
  • Refunds, disputes, and chargebacks are handled according to Stripe processes, creator policies, and our moderation decisions.
  • You agree to cooperate with identity, business, and compliance checks required by Stripe or Sizely.

8. Intellectual property

  • Your content: You keep ownership of content you upload. You grant Sizely a license to host, display, process, and deliver that content as needed to run the service (including CDNs and backups).
  • Sizely: The Sizely name, product UI, and platform software are owned by the Sizely project and its licensors. You may not copy the platform or brand for competing services without permission.
  • Feedback: If you send ideas or feedback, we may use them without obligation to you.

9. Copyright complaints

If you believe content on Sizely infringes your copyright, email support@sizely.io with:

  • Your contact details
  • Description of the work
  • URL / location of the material
  • A statement that you have a good-faith belief the use is unauthorized
  • A statement that the information is accurate and you are authorized to act

We may remove or disable access to material and, where appropriate, terminate repeat infringers.


10. Availability

Sizely is provided on an “as available” basis. Features may change. We may perform maintenance, limit features, or discontinue parts of the service. We are not liable for downtime, data loss beyond reasonable backups, or creator-side failures.


11. Disclaimers

To the fullest extent permitted by law:

  • Sizely is provided “as is” without warranties of uninterrupted service, perfect security, or fitness for a particular purpose.
  • We do not control all creator content and do not endorse every creator offering.
  • You use creator sites and purchase digital goods at your own risk, subject to mandatory consumer rights that cannot be waived.

12. Limitation of liability

To the fullest extent permitted by law, Sizely and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill.

Where liability cannot be excluded, our total liability for claims relating to the service is limited to the greater of: (a) fees you paid to Sizely for platform services in the 3 months before the claim, or (b) €50.

Nothing in these Terms limits liability that cannot be limited under applicable law (for example certain consumer rights, or liability for fraud).


13. Indemnity

You agree to indemnify and hold harmless Sizely and its operators from claims arising out of your content, your sales (including sales that violate Stripe or other payment-provider rules), your misuse of the service, or your violation of these Terms or law — to the extent allowed in your jurisdiction.


14. Termination

You may stop using Sizely at any time. We may suspend or terminate access for violations or risk. After termination, sections that should survive (IP, payments already processed, disclaimers, liability limits) continue to apply.


15. Changes

We may update these Terms. We will update the “Last updated” date. Continued use after changes means you accept the updated Terms, except where local law requires additional consent.


16. Governing law

These Terms are governed by the laws applicable to the operator of Sizely as an independent project, excluding conflict-of-law rules. Mandatory consumer protections in your country of residence still apply where they cannot be waived. For disputes, contact support@sizely.io first so we can try to resolve them informally.
